WaterNET-CAD End User License Agreement

PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE
DOWNLOADING OR USING THE SOFTWARE. BY DOWNLOADING THE SOFTWARE, OR USING
THE SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT
AGREE TO ALL OF THE TERMS OF THIS AGREEMENT DO NOT DOWNLOAD AND/OR USE THE
SOFTWARE.

The Product is Copyright 2013 P.Kouknakos. You may use it and distribute it according
to this following License Agreement. If you do not agree with these terms, please remove
the Product from your system. By incorporating the Product in your work or distributing the
Product to others you implicitly agree to these license terms.
DEFINITIONS

1. "WaterNET-CAD" or "Software" refers to P.Kouknakos's program, in each case, supplied
by P.Kouknakos herewith, and corresponding documentation, associated media, and
online or electronic documentation.

2. "Trial Version" means a free version of the Software for personal use only, so identified,
to be used in one computer only and for a period of 30 days. In the Trial Version the drawing output commands are disabled.

3. "Registered Version" means a version which has been bought to P.Kouknakos.
LIABILITY DISCLAIMER
THE SOFTWARE IS DISTRIBUTED "AS IS". NO WARRANTY OF ANY KIND IS EXPRESSED OR
IMPLIED. YOU USE IT AT YOUR OWN RISK. NEITHER THE AUTHORS NOR P.KOUKNAKOS
WILL BE LIABLE FOR DATA LOSS, DAMAGES AND LOSS OF PROFITS OR ANY OTHER KIND OF
LOSS WHILE USING OR MISUSING THIS SOFTWARE, OR FOR ANY CLAIM BY ANY OTHER PARTY.
FOR WaterNET-CAD TRIAL VERSION ONLY

(a) The WaterNET-CAD Trial version may be freely distributed, with exceptions noted
below, provided the distribution package is not modified in ANY WAY.

(b) The WaterNET-CAD Trial version may not be distributed inside of any other software
package without written permission of P.Kouknakos.

(c) The WaterNET-CAD Trial version allows the user to publish its work according to the
license agreement, but nor P.Kouknakos nor any member of the company can be held
liable for the content or accuracy of the publication.

(d) You may use the accompanying Product free of charge for a period of 30 days for the
sole purpose of evaluating the Product. If, after 30 days, you wish to continue using
this Product, you are required to purchase it. In other case, you are required to remove
this Product, in its entirety, from all computers on which it is installed.

(e) You shall not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise
reverse engineer, or transfer the Product except as provided in this Agreement. Any such
unauthorized use shall result in immediate and automatic termination of this Agreement.

FOR WaterNET-CAD REGISTERED VERSION ONLY

(a) You may install and use the Software on a single computer; OR install and store the
Software on a storage device, such as a network server, used only to install the Software
on your other computers over an internal network, provided you have a license for each
separate computer on which the Software is installed and run. A license for the Software
may not be shared, installed or used concurrently on different computers.

(b) The WaterNET-CAD Registered version allows the registered user to publish its work
according to the license agreement, but nor P.Kouknakos nor any member of the company
can be held liable for the content or accuracy of the publication.

(c) The WaterNET-CAD Registered version guaranties to the registered user free updates
for a whole version cycle and for at least 12 (twelve) months.

(d) You shall not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise
reverse engineer, or transfer the Product except as provided in this Agreement. Any such
unauthorized use shall result in immediate and automatic termination of this Agreement.

TERMS

This license is effective until terminated. You may terminate it by destroying the program,
the documentation and copies thereof. This license will also terminate if you fail to comply
with any terms or conditions of this agreement. You agree upon such termination to destroy
all copies of the program and of the documentation, or return them to the author.

OTHER RIGHTS AND RESTRICTIONS

All other rights and restrictions not specifically granted in this license are reserved by us.

End User Software License Subscription Agreement for WaterNET-CAD

IMPORTANT - READ CAREFULLY. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND P.KOUKNAKOS. FOR THE SOFTWARE PRODUCT IDENTIFIED ABOVE, WHICH INCLUDES COMPUTER SOFTWARE AND RELATED DOCUMENTATION. BY INSTALLING OR OTHERWISE USING THE SOFTWARE, YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
P. KOUKNAKOS, a software engineer whose address is Merarhias 49, Serres, 62125, Greece (Diolkos3d) hereby grants to you a non-exclusive license (a License) to use the software product identified above (the Software) and the accompanying material and User Manual (the Documentation), if any, on the terms set forth below.

1. Grant of License Agreement. This License grants you the following rights.
SOFTWARE. Except as set forth below, you may use the Software on any single computer.
DOCUMENTATION. The documentation that accompanies the Software is licensed for internal, non-commercial reference purposes only.
TRANSFER. Internal. You may transfer your copy of the Software to a different device subject to the provisions of this Agreement.
No Transfer to Third Party. You may not transfer, including by way of indirect transfer, such as a consignment, the Software or Software License to any other end user.

2. Description of other rights and limitations
REVERSE ENGINEERING. You may not modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software, or any portion thereof.
COPYING. You may not copy the Software or Documentation except as specifically provided for by this Agreement.
SEPARATION OF COMPONENTS. The Software is licensed as a single product. You may separate the Software's component parts for use on more then one computer.
RENTAL/COMMERCIAL HOSTING. You may not rent, lease, lend, or provide commercial hosting services with the Software or Documentation.
PROPRIETARY NOTICES. You may not remove any proprietary notices, labels or marks on the Software or Documentation.
UPGRADES. You may use the Software only in conjunction with the upgraded product or you must destroy the upgraded product. To use Software identified as an upgrade, you must first be licensed for the software identified by P.Kouknakos as eligible for the upgrade. After installing the upgrade, you may no longer use the original software that formed the basis for your upgrade eligibility, except as part of the upgraded software. If the Software is an upgrade from an earlier version, this upgrade License will supersede any previous License.
ADDITIONAL SOFTWARE/SERVICES. This license applies to updates, supplements, add-on components that P.Kouknakos may provide to you or make available to you after the date you obtain your initial copy of the Software, unless they are accompanied by separate terms.

3. Termination
This License is in effect until terminated and will terminate automatically if you fail to comply with the limitations described herein. This License is valid for the period of one year from the date you purchase the Software. If this EUSLSA Agreement is not renewed and paid for by you prior to the anniversary date thereof, the License will terminate automatically. If this License Agreement is not renewed on or before its anniversary date, then additions and changes to the Software database can not be made, and the information stored in the Software database will be accessible in a read only mode.

4. Expiration of rights
Your rights to the Software set forth in Section 1 shall automatically expire if at any time you (a) are no longer employed by the Customer; or (b) are no longer the primary user of a licensed copy of the Software with a valid current update subscription; or (c) install any other version of the Software that is subject to a License. In either such event, you must cease use of the Software, uninstall it from the computer or device on which you installed it and destroy all copies of the Software and all of its component parts.

5. Consent to use of Data
You agree that P.Kouknakos and its affiliates may collect and use technical information gathered as part of the product support services provided to you, if any, related to the Software. P.Kouknakos may use this information solely to improve our product or to provide customized services or technologies to you and will not disclose this information in a form that personally identifies you.

6. Miscellaneous
This Agreement represents the complete agreement concerning this license between parties and supersedes all prior agreements and representations between them. The Agreement may be amended only in writing executed by both parties. THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT THOSE CONTAINED IN YOUR PURCHASE ORDER. If any provision of this Agreement is held to be unenforceable, for any reason, such provision shall be reformed to the extent necessary to make it excluded, and enforceable and the remainder of this Agreement shall nonetheless remain in full force and effect.

7. Limited Warranty
P.Kouknakos warrants that the media containing the Software, if provided by P.Kouknakos, is free from defects in material. Replaced Media and Documentation shall be covered by this limited warranty for the period remaining under the warranty that covered the original Software. Only if you inform P.Kouknakos of your problem with the Media during the applicable warranty period and provide evidence of the date you acquired the Media will P.Kouknakos be obligated to honor this warranty. THIS IS A LIMITED WARRANTY AND IT IS THE ONLY WARRANTY MADE BY P.KOUKNAKOS. P.KOUKNAKOS MAKES NO OTHER WARRANTY, REPRESENTATION, OR CONDITION, EXPRESS OR IMPLIED AND EXPRESSLY DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGMENT OF THIRD PARTY RIGHTS. THE DURATION OF IMPLIED WARRANTIES OR CONDITIONS, INCLUDING WITHOUT LIMITATION, WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE IS LIMITED TO THE ABOVE LIMITED WARRANTY PERIOD; SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY OR CONDITION LASTS, SO LIMITATIONS MAY NOT APPLY TO YOU. NO P.KOUKNAKOS AGENT OR SALES REPRESENTATIVE IS AUTHORIZED TO MAKE ANY MODIFICATIONS, EXTENSIONS, OR ADDITIONS TO THIS WARRANTY. If any modifications are made to the Software by you during the warranty period; if the media is subjected to accident, abuse, or improper use; or if you violate the terms of this Agreement, then this warranty shall immediately be terminated. This warranty shall not apply if the Software is used on or in conjunction with hardware or software other than the unmodified version of the hardware and software with which the Software was designed to be used as described in the Documentation. THIS WARRANTY GIVES YOU SPECIFIC RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY JURISDICTION.

8. Limitation of Liability
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL P.KOUKNAKOS OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE, OR MALFUNCTION, OR ANY AND ALL COMMERCIAL DAMAGES OR LOSSES, OR FOR ANY DAMAGES IN EXCESS OF P.KOUKNAKOS LIST PRICE FOR A LICENSE TO THE SOFTWARE AND DOCUMENTATION, EVEN IF ARCHIVE POWER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY .
